Changes concerning trademarks

On February 20, 2019, the Polish Parliament passed an act amending the Industrial Property Law. This amendment results in a significant extension of the definition of a trade mark.

Until now, a trademark could have been any designation provided that it can be represented graphically. At present, this limitation has been removed and the trade mark can be any sign possible to be presented in the trade mark register in a manner allowing to determine the unambiguous and exact subject of granted protection.

According to the justification of the amending act, its aim is to adapt the provisions to the current possibilities in the area of creating trademarks, which is given by modern technology.
